Press Release – March 26, 2020 Apprehension of Suspect for Disobedience to Agent of Person in Authority in relation to EO-25 (Curfew Hours) and Alarm and Scandal

PSSg Mark Vincent B. Dayondon and PCpl Jesryl O. Rebuera, Mobile Patroller, Surigao City Police Station brought the living bodies of Nico Estrella Vicio, male, 19 years old, single, hollow block maker, and Nathaniel Campaña Selades, 21 years old, single, hollow block maker, both residents of Purok-3, Brgy. Honrado, San Francisco, Surigao Del Norte on March 24, 2020 around 10:00PM, for violation of Article 151 (Disobedience to an Agent of a Person in Authority of the RPC) in relation with the Implementation of Executive Order No. 25 Series of 2020 (Observance of Curfew Hours) that happened around 9:45PM in Borromeo Street, near Geckos Disco Bar, Barangay Taft, Surigao City.

The patrol officers were conducting roving at the vicinity of Barangay Taft, Surigao City, upon reaching TT and Company, suspects were seen roaming around. They were advised to go home but they mockingly yelled bad words towards the police officers (OO LAGI MGA JAWA KAMO NA MGA PULIS) which prompted them to arrest the suspects, however, suspects runaway but they were chased until they were arrested near Geckos Disco Bar.

Suspects were brought to Surigao City Police Station for documentation and for filing of case against them after apprising their Constitutional Rights as construed in the Miranda Doctrine and the nature of their arrest to the language known to them and the Anti Torture Act.

Apprehension of Suspect for Alarm and Scandal/Resistance and Disobedience to an Agent of Person in Authority in relation with the Implementation of EO-25 (Observance of Curfew Hours)

Barangay Luna Tanods led by Joel Bacolod Fernandez brought the living body of Percibal Esconde Arboys, 22 years old, single, jobless, and resident of Gawad Kalinga, Sitio Looc, Brgy. Luna, Surigao City on March 25,2020 around 1:45AM for Alarms and Scandals/violation of  Article 151 (Resistance and Disobedience to an Agent of a Person in Authority,) in relation with the Implementation of Executive Order No. 25, Series of 2020 (Observance of Curfew Hours) that happened around 1:20AM of March 25, 2020 in Gawad Kalinga, SitioLooc, Brgy. Luna, Surigao City.

The said Barangay Tanods were conducting roving patrol in consonance to EO 25 (Observance of Curfew Hours) at the vicinity of Barangay Luna, Surigao City, when GK Purok Chairman Welson Tura Mal-ang called their attention that there were group of male persons doing scandalous act that alarmed the public. Said Barangay Tanods then proceeded thereat and as they arrived, one of them yelled “HAE MAN TON MGA TANOD NA WAYAY MGA BOOT!” and even mocked their arrivals. During the apprehension, said suspect resisted and even tried to harm them while the other two male suspects flee from the scene identified as Julan Malinao and Tata Alolor.

Subsequently, suspect brought to Surigao City Police Station for documentation and filing of case.

Apprehension of Suspects for Violation of Presidential Decree No. 1865 (Law of Petroleum)

Personnel of Claver Municipal Police Station led by PCAPT AUDREY ROSE R RIVERO,  Bureau of Fire Protection led by FINSP GERMAN L MELO JR and 2nd SDN PMFC while conducted a Quarantine Control Point (checkpoint) for COVID-19 in Brgy. Daywan Claver, Surigao del Norte on March 25, 2020 around 9:10PM, has flagged down a Mitsubishi Truck Tank Lorry bearing a Plate No.  AAV 6648 owned and driven by GLENN CAGADAS LULAB , 41 years old, married with helpers, certain Jerome Pegaro Bawaan, 28 years old, single, Reynante Frias Pegaro, 31 years old, married and Leonito Cagnaan Mullet, 35 years old, all residents of P8- Brgy. San Pedro, Alegria, Surigao del Norte. The said truck has a label in front of the vehicle “Insular Oil Corporation, Delivery of Vital Energy Good/Services, Kindly Don’t Delay.  Upon inspection, the said tanker was modified and its cubicle was loaded with containers of petroleum products. Suspects believed, intends to defraud trading of petroleum products and or possession of adulterated finished petroleum products for the purpose of sale, distribution, transportation, exchange or barter.

Confiscated in the possession of the suspects were 120 containers of petroleum products consisting of 3,600 liters with an estimated value of Php 118,800.00 pesos.

Arrested suspects were duly informed of their constitutional rights under Miranda Doctrine and Anti Torture law.

Suspects and pieces of evidence to include the lorry tanker are in custody of Claver Municipal Police Station for appropriate filing of a case.

Apprehension of Suspects for Disobedience To an Agent of Person in Authority in relation with the Implementation of EO-25 (Curfew Hours)

Surigao City Police Station brought the living body of Rowel Calinawan Bergas, 41 years old, married, construction worker, resident of Purok-Camia, Brgy Taft, Surigao City for violation of Article 151 (Disobedience to an Agent of Person in Authority, RPC) in relation with the implementation of Executive Order No.25 Series of 2020 (Observance of Curfew Hours) that happened around 10:45PM of March 24, 2020 in Narciso Street corner P. Reyes St., Brgy Taft, Surigao City.

Said patrol officers were conducting roving patrol at the vicinity of Barangay Taft, Surigao City, upon reaching Narciso corner P. Reyes Street, aforesaid suspect was seen roaming around. He was advised to go home but he utterly showed disrespect and yelled towards said police officers bad words. During the course of his arrest, he tried to resist and even tried to harm the police officers but he was overwhelmed.

He was brought to Surigao City Police Station for documentation and for filing of case against him after apprising his Constitutional Rights as construed in the Miranda Doctrine and the nature of his arrest to the language known to him and the Anti Torture Act.
