Implementation of Search Warrant that led to an Armed Encounter
On November 27, 2020 around 12:45 AM in Purok 2, Brgy. San Pedro, Sison, Surigao del Norte, a joint operation was conducted by personnel of Sison Municipal Police Station led by PCPT ARNEL T BANAKEN, OIC, and 1st SDN PMFC in the implementation of Search Warrant to the house occupied by JOSEFINO CALANG a.k.a LALO, of legal age, Filipino, married, jobless and a resident of the aforementioned place, issued and signed by HON NOEL C PANGILINAN, Presiding Judge of 10th Judicial Region, 2nd Municipal Circuit Trial Court, Sison-Tagana-an, Surigao del Norte, dated November 17, 2020 for Violation of R.A. No. 10591 that resulted in an armed confrontation.
During the implementation of the search warrant and after announcing the authority and purpose, nobody came out to respond to the announcement of the operatives but instead, they heard a commotion coming from the subject’s house which led them to gain entrance thru the wooden main door of the house to protect their lives from any threats of whomever inside the house.
Eventually, the occupant comes out from his room and suddenly drew his short firearm and engaged the PNP operatives by shooting them several times. Fortunately, no one from the members of the operating team was hit, and was able to defend themselves by returning fire and neutralized the suspect.
The implementation of the search warrant was done in the presence of independent and credible witnesses, namely, Wardell Paronia, Punong Barangay of San Pedro, and Ricardo D Garcia, Brgy. Kagawad of San Pedro). Items recovered were as follows:
- One (1) Hand Grenade marked as “MGL-11-27-2020-1”; and
- Two (2) Cartridge for Cal. 38 “MGL-11-27-2020-2”
After the lawful search and inventory of recovered pieces of evidence in the room occupied by the suspect, Sison MPS has requested SOCO Assistance from SDN Crime Laboratory to process the crime scene and arrived around 2:25 AM of the same date. Recovered from the suspect’s possession and at the crime scene during the processing were as follows:
- One (1) Cal. 38 Revolver “World MPC” with serial No. 776787;
- Three (3) Cartridge of Cal. 38;
- Three (3) Fired Cartridge cases of Cal. 38; and
- One (1) fired Cartridge of 9MM
Crime scene processing and turned-over of the crime scene ended around 3:31 AM of the same date. The dead body of the suspect was turned-over to Barangay Official of San Pedro, Sison, Surigao del Norte and was then brought to Arpilleda Funeral Homes in the municipality of Tagana-an.
Recovered pieces of evidence were then brought Sison MPS for proper disposition and subsequently turned before the office of HON NOEL C PANGILINAN, Presiding Judge of 2nd Municipal Circuit Trial Court, Sison – Tagana-an, Sison, Surigao del Norte. Moreover, the subject of the search warrant was known to be an active member of Militia ng Bayan (MB) and allegedly acted as ‘eyes and ears’ of CTGs in the area of Sison municipality. He was also the father of a certain Ka Badi who is an active member of NEMRC GF16A operating on some parts of Surigao del Norte.
Accomplishment of Illegal Logging
A cellular phone call from one of Barangay Intelligence Network(BIN) of Burgos Municipal Police Station on November 26, 2020 at about 4:45 PM, informing that there was an alleged illegal logging activity at the mountainous Area of Barangay Matin-ao, Burgos, Surigao del Norte.
Immediately, personnel of Burgos MPS led by PSSg Rolly E. Estella, Intel PNCO under the supervision of PLT ERIC V DANGATE OIC, proceeded at the aforesaid place. Upon arrival thereat, the responding police officer saw three (3) men identified as Jobert Alcala Laurente, 38 years old, married, male, carpenter and resident of Barangay Sto. Niño, San Isidro, SDN; Reo Alcala Laurente, 35 years old, married, male, farmer resident of Barangay Sto. Niño, San Isidro, SDN; and Ronelio Cariaga Sulapas, 44 years old, married, male, farmer, and resident of Barangay Matin-ao, Burgos, Surigao del Norte cutting and slicing a round logged that converted to lumber.
Upon verification of the documents or permits, suspects failed to show any documents allowing them to operate. Confiscated items from their possession were:
- One (1) unit chainsaw (STHIL BRAND);
- One (1) piece 2x12x8 and one (1) piece 1x15x4 (locally known as Hagdanuwak or Bokbok) with an estimated market value of one thousand five hundred pesos (Php 1,500.00).
Thereafter, the suspects have informed of the nature of their arrest and their constitutional rights under Miranda Doctrine and Anti-Torture Warning in a dialect understood by them.
The suspect and confiscated items were brought to the Burgos MPS for proper disposition.
